# Belarus Tax Optimization

## Belarus Tax Optimization Skill v0.1

**Tier 2 — research-verified. Sources: MNS (Ministry of Taxes and Duties), PwC, Allford/Chandrawat. Figures must agree with `belarus-income-tax.md` / `belarus-social-contributions.md`. NOT yet signed off by a Belarusian tax adviser. Aggressive positions are never advised; every suggestion must be reviewed. NOTE: Belarus is TIGHTENING its small-business regimes — this playbook is as much about compliance as savings.**

## Section 1 -- Quick Reference

**Quick Reference**

| Field | Value |
| --- | --- |
| Country | Republic of Belarus |
| Currency | BYN (rouble) |
| Headline reality | Individual-entrepreneur regimes are being **restricted**; simplified/unified tax **excluded for IT and many activities**; many IPs must convert to LLC |
| IP general tax | 20% on (income − expenses), or 20% on income; **30%** if annual income > BYN 500,000 |
| HTP (IT) | Reduced regime for High-Tech Park residents |
| Dividends | 6%/0% preferential rates being **withdrawn**; share capital gains now **13%** (from 2025) |
| Anti-avoidance | Activity-list compliance; IP-to-LLC transition deadline |

- **IP-to-LLC transition audit flash point** — From registration after 1 Oct 2024 and for all existing IPs by 31 Dec 2025, individual-entrepreneur activity is limited to an approved list; IPs outside it must cease or convert to an LLC. Do not plan around the old IP simplified regimes without checking this. _(AUDIT FLASH POINT — major transition)_

## Section 2 -- Individual Entrepreneur (IP) — restricted

- **General system tax rate** — 20% on net income (documented expenses) or 20% on income; 30% above BYN 500,000/yr.
- **Simplified/unified tax excluded for IT** — The simplified/unified tax has been narrowed and is excluded for IT services and many activities — IT sole proprietors may use only the general 20% system.
- **Permitted activity list / LLC conversion** — Confirm the activity is on the permitted IP list, or plan the conversion to LLC before 31 Dec 2025.

## Section 3 -- Self-Employed (private person, no IP)

- **Self-employed scheme description** — Individuals providing services without IP registration operate under a simplified self-employed scheme.
- **Social Protection Fund contributions** — No mandatory Social Protection Fund contributions (voluntary, to build pension service). Useful for genuinely small/occasional activity. [RESEARCH GAP — reviewer to confirm the current self-employed activity list and tax amount.]

## Section 4 -- HTP (High-Tech Park) for IT

- **HTP resident regime** — HTP residents access a reduced regime (e.g. 9% on certain digital-asset/token revenue) and IT-sector benefits — the company (HTP-resident LLC) route, not the restricted IP route, is the way IT businesses optimise. [RESEARCH GAP — reviewer to confirm current HTP rates and conditions.]

## Section 5 -- Dividends & Capital Gains (2025 changes)

- **Preferential dividend rates phased out** — The preferential 6% and 0% corporate dividend rates are being phased out — model the current rate.
- **Capital gains tax on Belarusian company shares** — 13%

## Section 6 -- Red Lines (do not cross)

- **IP activity-list / LLC conversion deadline** — IP activity-list / LLC conversion (31 Dec 2025): the single biggest compliance item — don't operate outside the permitted list.
- **IT excluded from simplified tax** — IT excluded from simplified tax — IT sole proprietors must use general 20%.
- **Lapsing dividend rates** — Don't rely on the lapsing 0%/6% dividend rates.

## PROHIBITIONS

- **NEVER advise IT activity under IP simplified/unified tax** — NEVER advise IT activity under the IP simplified/unified tax — it is excluded (general 20% only).
- **NEVER plan around IP regime without deadline** — NEVER plan around the IP regime without the activity-list / LLC-conversion deadline.
- **NEVER present 0%/6% dividend rates as current** — NEVER present the 0%/6% dividend rates as current.
- **NEVER contradict related skill rates** — NEVER contradict the rates in `belarus-income-tax.md` / `belarus-social-contributions.md`.
- **NEVER present RESEARCH GAP figures as confirmed** — NEVER present [RESEARCH GAP] figures as confirmed, nor optimisation as definitive advice — route to a licensed Belarusian tax adviser.
